The following considerations shall be taken into
account when assessing the rate of disability in the case of the
loss of organs:-
- The surgery must have healed completely without leaving any
residual complications or handicap to the movement of the surviving
joints, such as cicatrixes, fibrositis, calcinosis, inflammation,
sensory complications, etc. the rate of disability shall increase
according to the residual of these complications.
- In the case of complications of amputation, the casual condition
of disability and complications shall be described in the medical
certificate. The degree of handicap of each movement of such joints
shall be determined in accordance with the normal rules in practice.
- In the case of sensory complications, the location thereof must
be specified and the extent of the increase or decrease of sensitivity
and the nature thereof must be determined.
- Where the injured is left-handed, the degree of his incapacity
arising out of injuries to an upper left limb shall be assessed
on the basis of the percentages indicated for such incapacity
of the upper right limb.
- Where one of the above mentioned organs or limbs is permanently
and totally incapacitated, it shall be deemed to have been lost;
and if such disability is partial, the degree thereof shall be
assessed on the basis of the incapacity of function of that limb.
- Save as provided for in Clause 3 of Article 59, where an injury
has resulted in the loss of a part or more of the members specified
in the Schedule, the percentage of the degree of incapacity shall0®e
assessed within the percentage indicated for the loss of such
member, and in no circumstance shall it exceed such percentage.

- The degree of disability resulting from the diminution of vision
shall be assessed as the eye before and after injury, if there
is a record for the degree of vision before injury (column 4).
- Where there is no such record, the vision shall be deemed to
have been perfect - 6/6.
- Subject to the provision of Clause (1) above, the degree of
disability in the case of an injury to the eye of a one-eyed person
shall be assessed on the basis that the full capacity of such
eye had been 100% (column 3).
- The loss of the vision of the only eye shall be deemed to be
total disability.
- Subject to the provision of Clause (1) above, the degree of
disability in the case of an injury to both eyes shall be assessed
on the basis of half the total of the capacity of vision of both
eyes, i.e. the vision of each eye is 50% (column 3).
PART 3
Loss of Hearing
a. |
The hearing shall be deemed to
be intact if diminution does not exceed 15 decibles in each
ear. |
b. |
The rate of the loss of hearing
in a single ear shall be 1.5% for the loss of each single decibel
in excess of 15 decibles. |
c. |
The rate of the loss of hearing
shall be deemed to be 100% if the average of diminution of the
faculty of hearing of both ears amounts to 85 decibels, and
in this case the degree of incapacity shall be 55% of the total
incapacity. |
The following considerations shall be taken into account when assessing
the degree of residual incapacity resulting from the loss of hearing:-
- Loss of hearing shall be measured in comparison with the average
of the faculty of hearing to sounds the frequency of which ranges
between 125 and 100 cycles per second.
Assessment of the diminution of hearing shall be tested by an
electric auditory measuring apparatus in order to ascertain easily
the degree of vibration which is not easily measured by a tuning-fork.
- The degree of incapacity arising from the diminution of hearing
shall be assessed as the difference between the degree of hearing
before and after injury if there is a record indicating such degree.
- Where there is no such record, the hearing shall be deemed to
be 100% perfect, having regard to the age of the insured by adding
a half decibel for each year after the age of 45 years.
- Subject to the provision of Clause (2) above, the degree of
incapacity in the case of an injury to the only ear shall be assessed
on the basis that the full hearing capacity of such ear had been
100%.
- Subject to the provision of Clause (4) above, the degree of
hearing in the case of an injury to both ears resulting in different
degrees of diminution of hearing shall be assessed as follows:-
a. |
the percentage of the loss of hearing
of both ears = (rate of loss of hearing in the stronger ear
x 5) + rate of loss of hearing in the weaker ear) ÷ 6. |
b. |
the degree of incapacity shall
be assessed on the basis that the rate of 100% loss or hearing
equals 55% of the total incapacity. |
It is stipulated for all the foregoing that the state of incapacity
has been established firmly.
Any work or process involving the use or handling of lead and its
compounds or materials containing lead including:-
Handling ores containing lead, melting old lead and zinc (scrap)
into ingots.
