Decree

  DECREE LAW NO. 1/1985 AMENDING THE LAW ON SOCIAL INSURANCE PROMULGATED BY DECREE LAW NO. 24 OF 1976

We, Essa bin Sulman Al Khalifa, Amir of the State of Bahrain, Having reviewed the Constitution; And Amiri Order No. 4 of 1975; And Decree Law No. 24 of 1976 promulgating the Law on Social Insurance and laws in amendment thereof; And upon the submission of the Minister for Labour and Social Affairs; And with the approval of the Council of Ministers; HEREBY DECREE THE FOLLOWING LAW :

Article 1

For the provisions of Paragraph 2 of Article 16, Article 53 and Paragraph 3 of Article 135 of the Law on Social Insurance promulgated by Law No. 24 of 1976 herein above referred to, there shall be substituted to the following provisions:

Paragraph 2 of Article 16 "The examination shall take into account the value of current liabilities and if it is in the report of the actuary that a surplus is available, such surplus shall then be transferred to a special account in the Fund and may not be disposed of except with the approval of the Board of Directors for the following purposes:

  • Settlement in whole or in part of the deficit which the State Treasury has made good by payment of loans to the General Organisation for that purpose.
  • Increase in pensions compensations, daily allowances, additional grants, contributions and bonuses in the light of the cost of living index. The increase in pensions, compensations, daily allowances, additional grants, lump sums, minimum and maximum levels of pensions prescribed under the provisions of this Law as well as the percentages of all the mentioned shall be determined by an Order of the Council of Ministers, upon a recommendation from the Minister for Labour and Social Affairs.
  • Establishment of a general reserve fund and special reserves."
  • Article 53
    "The daily allowance shall equal 100% of the contributory daily wage of the injured insured, and shall be paid for the duration of the incapacity resulting out of the employment injury or, in the case of relapse of the injury or the complication thereof."

    "The daily allowance shall be calculated on the basis of the monthly wage used for payment of the contribution divided by thirty (30) and the General Organisation shall be responsible for its payment to the injured."

    Paragraph 3 of Article 135 "The maximum pension provided for in the first Paragraph of this Article shall be 75% of the wages on the basis of which the pension in both branches of the social insurance was calculated as the case may be."

    Article 2
    The provisions of the third Paragraph of Article 135 as amended by this Law shall only apply to pensions due after the effective date thereof.

    Increases arising from the enforcement of this Law shall be borne by the General Organisation for Social Insurance.

    Article 3
    The Minister for Labour and Social Affairs shall issue the necessary orders required for implementing the provisions of this Law.

    Article 4
    The Ministers, each in his respective capacity, shall implement this Law which shall come into effect on the first day of the month following the date of its publication in the Official Gazette.
