PART 4: MINISTERIAL ORDERS

  ORDER NO. 17/1986 RESPECTING THE FORMATION OF AN APPELLATE MEDICAL COMMISSION FOR EMPLOYMENT INJURIES

The Minister for Health; In pursuance of Article 126 of the Labour Law for the Private Sector, No. 23 of 1976; And Articles 4, 72 and 73 of the Social Insurance Law, No. 24 of 1976; And Legislative Decree No. 9 of 1986 with respect to amending certain provisions of Law No. 13 of 1975 governing Pensions and Retirement Benefits for Civil Servants and Government Employees, as amended; And the Order of the Minister for Health No. 4 of 1976 with respect to the formation of the Medical Commissions and Determining their Duties; And upon the recommendation of the Undersecretary of the Ministry of Health; ORDERS :

Article 1

An Appellate Medical Commission shall be formed to re-examine the decisions of doctors treating employment injury cases as follows:

  • Chief of Medical Staff in Sulmaniya Medical Centre or his Deputy.-- Chairman.
  • Head of the Department to which the doctor responsible for treatment belongings. -- Member.
  • A consultant doctor in the said Department-- Member.
  • Chief of Occupational Health Department -- Member.
  • Article 2

    The Committee shall be responsible for re-examining the decisions of the medical institutions undertaking the treatment and to which reference has been made by the Pension Fund Commission or the General Organisation for Social Insurance or by workers in the Private Sector who are not yet subject to the provisions of the employment injury insurance provided for in the Social Insurance Law, with respect to the following :

    1-Return to work.

    2-Cured of a temporary disability without permanent incapacity

    3-Cured of a temporary disability without permanent incapacity

    4-Appropriate transportation for the injured workman to the medical institution.

    Article 3

    Resolutions of the Commission shall be adopted by a majority vote. In case of an equality of votes, the Chairman shall have a casting vote. Resolutions of the Commission shall be final.

    Article 4

    Applications for re-examination of decisions relating to the assessment of the degree of disability, or applications for the treatment of employment injuries outside Bahrain and such other decisions issued by the concerned Medical Commissions shall be heard before the main Appellate Medical Commission formed in accordance with Article 4 of the Minister for Health Order No. 4 of 1976.

    Article 5

    The Undersecretary of the Minister for Health shall issue the instructions for implementing this Order. .

    Article 6

    The Undersecretary of the Minister for Health shall implement this Order which shall come into effect from the date of its publication in the Official Gazette.
