PART 4: MINISTERIAL ORDERS

  MINISTERIAL ORDER NO. 9/INSURANCE DATED 23.9.1976 WITH RESPECT TO RECORDS AND FILES TO BE MAINTAINED BY THE EMPLOYERS SUBJECT TO LAW ON SOCIAL INSURANCE

The Minister for Labour and Social Affairs, After referring to Article 100 of the Law on Social Insurance issued by Decree Law No. 24/1976; And the Ministerial Orders No. 3, 4 and 6/Insurance issued on 25.8.1976 and 4.9.1976; And with the consent of the Board of Directors of the General Organisation for Social Insurance; HEREBY ORDERS :

Article 1

The employers subject to the Law on Social Insurance and employing one thousand (1000) workers or more and each employer who assigns all or some of his work to contractors or sub-contractors and who may jointly fulfil the conditions with respect to the application of Social Insurance Law, shall maintain the following registers even if the original employer or the sub-contractor has not singly exhausted the said number of workers :

  • Register for entering the insured workers.
  • Register for entering the monthly wages for the insured workers.
  • Register for entering the insured workers and the payment of their insurance contributions to the General Organisation for Social Insurance.
  • Register for entering the employment accidents and occupational diseases.
  • Register for entering the sub-contractors to whom works have been assigned by the employer subject to Social Insurance.
  • All the aforementioned registers shall be maintained permanently.

Article 2

The registers mentioned in the foregoing article shall be established in accordance with forms attached to this Order.

Employers or contractors may, on application by them, be exempted upon the consent being granted by the Minister for Labour and Social Affairs, from complying with some of these forms or all of them or may be replaced by alternative forms whenever it is easier for purposes of work at the General Organisation and for the employers and particularly with computerised system provided that the said system should include the particulars mentioned in these forms.

Article 3

Each of the employers and sub-contractors mentioned in Article 1 of this Order shall be required to open a file for each worker employed by him. There shall be maintained in this file copies of all the forms related to the Social Insurance and pertaining to the worker as well as the correspondence exchanges in this regard between the employer or the sub-contractor and the General Organisation for Social Insurance and between him and the Police station concerned or between him or the Ministry of Health, hospital or the hospital assigned for the workers or the doctor-in-charge at the time of the occurrence of any employment accident or any occupational disease to the worker. The said documents shall always be maintained in these files.

Article 4

This order shall be published in the Official Gazette and it shall come into effect as from the 1st October 1976.
