PART 4: MINISTERIAL ORDERS

MINISTERIAL ORDER NO. 6/1980 WITH RESPECT TO PROCEDURES
FOR IMPLEMENTING AMIRI DECREE-LAW NO. 8/1980
WITH RESPECT TO AWARD OF INCREMENTS TO
PENSIONERS AND BENEFICIARIES THEREOF


The Minister for Labour and Social Affairs,

After referring to the Social Insurance Law issued by Decree-Law No. 24/1976 and amendments thereof;

And to Amiri Decree-Law No. 8/1980 with respect to award of increments to pensioners and beneficiaries thereof;

Hereby orders :

Article 1

In the application of the provisions of Amiri Decree-Law No. 8/1980 the pensions eligible for the increments awarded to pensioners and beneficiaries thereof, in accordance with the provisions of the Social Insurance Law referred to, shall mean the following categories :

(a) Pensioners who receive pensions in accordance with the provisions of Decree-Law No. 24/1976 and amendments thereof;

(b) Each individual beneficiary of the pensioners mentioned in the foregoing clause.

Article 2

The increments mentioned in the aforesaid Decree-Law No. 8/1980 shall be calculated in respect of the category indicated in Clause (a) of Article 1 according to the original monthly pension received by each pensioner as determined in the classification of the said monthly pension. Increments shall be paid every month together with the pension. Increments in respect of the category mentioned in Clause (b) of Article 1 shall also be calculated on the basis of the pension received by each of the pensioner's individual beneficiaries.

Article 3

The total increments to be paid to each pensioner's beneficiaries shall not be less than BD. 7.500, if total pensions paid thereto shall be BD. 50 or more.

If the pension of a beneficiary devolves to one or more beneficiaries, such development shall be restricted to the original pension which used to be paid before the award of the increment.

Without prejudice to the provisions of Paragraph One of this Article the increment shall be modified in respect of each beneficiary in view of any alteration which has been effected to the pension which is being paid thereto.

Article 4

The Social Insurance Funds shall be responsible, each in its respective capacity, for the award of the increments provided for by the aforesaid Decree Law No. 8/1980.

Article 5

This order shall be published in the Official Gazette and shall come into effect as from 1st February 1980 and the Director of the General Organisation for Social Insurance shall implement its provisions.
